2. Description of Service

NextLevelApp is an AI-powered platform that generates marketing video content from product images. The Service includes:

  • AI-generated product images and videos
  • Video composition and rendering
  • Asset storage and download capabilities
  • Subscription-based credit system

3. Account Registration

3.1. You must create an account to use the Service.

3.2. You must provide accurate and complete information during registration.

3.3. You are responsible for maintaining the confidentiality of your account credentials.

3.4. You must be at least 18 years old to use the Service.

4. Subscription and Payments

4.1. Pricing: The Service operates on a subscription model with different tiers (Starter, Growth, Scale).

4.2. Billing: Subscriptions are billed monthly. Payments are processed through Stripe.

4.3. Credits: Each subscription provides a set number of credits. Credits are used to generate content.

4.4. Refunds: Due to the nature of AI-generated content, refunds are generally not provided once credits have been used. Unused subscription periods may be refunded at our discretion.

4.5. Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. Acceptable Use

You agree NOT to:

  • Upload content that infringes on intellectual property rights of others.
  • Generate content that is illegal, harmful, threatening, abusive, or violates any laws.
  • Use the Service to create misleading or deceptive advertising.
  • Attempt to reverse engineer or exploit the Service.
  • Share your account credentials with others.
  • Use automated systems to access the Service without permission.

6. Intellectual Property

6.1. Your Content: You retain ownership of the product images you upload.

6.2. Generated Content: You receive a commercial license to use all AI-generated content (images, videos, music) for your business purposes, including advertising.

6.3. Our Platform: The Service, including its technology, design, and branding, remains our intellectual property.

6.4. License Grant: We grant you a non-exclusive, worldwide license to use generated content for commercial purposes, including:

  • Social media advertising (TikTok, Instagram, Facebook, YouTube)
  • Website and e-commerce use
  • Digital marketing campaigns

7. AI-Generated Content Disclaimer

7.1. Quality Variations: AI-generated content may occasionally contain imperfections or artifacts. This is inherent to current AI technology.

7.2. Regeneration: Each Creative Pack includes bonus credits for scene regeneration if results are unsatisfactory.

7.3. No Guarantee: We do not guarantee that generated content will meet specific expectations or requirements.

7.4. Human Review: We recommend reviewing all generated content before publishing.

8. Limitation of Liability

8.1. The Service is provided "as is" without warranties of any kind.

8.2. We are not liable for any indirect, incidental, or consequential damages.

8.3. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8.4. We are not responsible for any losses resulting from:

  • Service interruptions or downtime
  • Loss of data or content
  • Third-party actions or content
  • Use of generated content in violation of these Terms

9. Data Protection

9.1. We process personal data in accordance with our Privacy Policy and GDPR.

9.2. Uploaded images are processed solely for content generation and are stored securely.

9.3. You may request deletion of your data at any time.

10. Termination

10.1. We may suspend or terminate your account for violation of these Terms.

10.2. Upon termination, your access to generated content may be revoked.

10.3. You may request data export before account deletion.

11. Changes to Terms

11.1. We may modify these Terms at any time.

11.2. Continued use of the Service after changes constitutes acceptance.

11.3. Significant changes will be communicated via email.

12. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in Polish courts.
